Donation terms (public offer)

Who is offering

Charitable Organisation «Maksym Tereshchenko Charitable Foundation», legal entity identification code 44908157, registered at 15 Stalevariv St, Zaporizhzhia, Ukraine, represented by its director Maksym Volodymyrovych Tereshchenko acting under the Charter.

Under Article 641 of the Civil Code of Ukraine, the offer is addressed to an unlimited number of individuals with legal capacity and private legal entities who wish to make a charitable donation. It takes effect from the moment it is published on the foundation's website, has no expiry date, and may be amended or withdrawn by the foundation at any time before acceptance.

Subject of the agreement

The donor transfers funds to the foundation free of charge and voluntarily, for the foundation's statutory activity. The donor sets the amount. The foundation determines how the donation is used within its statutory activity, unless the donor has specified a purpose in the manner set out in the agreement. Neither party derives profit from the agreement. The transfer is recognised as a charitable donation under Article 6 of the Law of Ukraine «On Charitable Activity and Charitable Organisations».

Activity of the foundation

The foundation acts in accordance with its Charter, including support for the country's defence, restoration and establishment of peace, and the development of society - during and after martial law, during and after emergencies, in the period of recovery, and in peacetime. The foundation is non-profit. Information about its activity and reports on results are published on the website.

Making a donation

  • The donor sets the amount of the donation.
  • A charitable donation is voluntary and is not refundable to the donor.
  • Donations are used to carry out the foundation's charitable activity in accordance with its Charter and the law of Ukraine.
  • Payment methods: a one-off payment, or a subscription with monthly or annual payments of any amount. A subscription can be cancelled at any time through the donor's own bank services.

Rights and obligations

The foundation undertakes to use donated funds strictly in accordance with the law of Ukraine and only within its statutory activity. It may determine the direction of use itself, except where the donor has agreed a specific purpose under a separate agreement.

The donor is entitled to information about the use of their donation. The foundation may publish monthly financial reports covering donations received and expenditure for the reporting period, and on the donor's written request may confirm the targeted use of a donation with supporting documents.

By making a donation, the donor confirms their legal capacity, that the transaction is voluntary, and that the donated funds are not subject to any prohibition, seizure, pledge or third-party rights and were not obtained in breach of Ukrainian anti-money-laundering and counter-terrorist-financing legislation.

Acceptance

Acceptance means full and unconditional acceptance of the public offer by making a money transfer through the payment forms and tools published on the website, or by transferring funds to the foundation's bank account. The moment of acceptance is the date of the transfer and/or of the funds being credited to the foundation's account. From that moment the agreement is considered concluded.

Acceptance also means the donor agrees that the foundation may use part of the donation for administrative expenses, in an amount no greater than permitted by the law of Ukraine.

The foundation processes the personal data provided by the donor when visiting the website and/or making a transfer, for the purpose of performing this agreement and its statutory activity.

Final provisions

The relationship between the donor and the foundation is governed by the applicable law of Ukraine. Disputes are to be resolved through negotiation and, failing that, by the courts in accordance with Ukrainian law.
